TERMS OF SERVICE

1. AGREEMENT TO TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “user,” ) and Back to Basics Behavior Services, LLC, doing business as Chatterfly, which operates the application known as Chatterfly App (“Chatterfly App,” “Chatterfly”, “Back to Basics Behavior Services, LLC”, “we,” “us,” or “our”). By accessing, downloading, installing, or using the Chatterfly App mobile application, website, or any services, features, content, or materials made available through Chatterfly App (collectively, the “Services”), you agree that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately discontinue use of the Services and delete your account. Users agree that they are responsible for ensuring that their use of the Services complies with these Terms. Use of the Services is also governed by our Privacy Policy, which forms an integral part of this Agreement.

2. SERVICES BY CHATTERFLY APP

Chatterfly App is an audio-based conversation practice application designed to enhance communication skills and provide general learning experiences through interactive, AI-powered dialogue tools as well as how-to guides and practice exercises. Chatterfly App is not therapy, not counseling, and not a medical platform, nor does it provide medical, behavioral, mental-health, pharmaceutical, diagnostic, or treatment guidance. The Services support communication and socialization outcomes but do not replace professional services of any kind.

3. ELIGIBILITY

3.1. Age Requirements

  1. The Services are not intended for children under 13.

  2. Children ages 13–17 may use the Service only with parental permission.

  3. Users 18 and older may create their own accounts.

4. LICENSE TO USE THE SERVICES

Subject to compliance with these Terms, Chatterfly App grants you a limited, non-exclusive, non-transferable, revocable license to:

  1. Download and use the Chatterfly App mobile application.

  2. Access the Services.

  3. Use the audio interaction tools.

  4. Access features intended for users.

  5. Use the content strictly for personal, non-commercial purposes.

You may not use the Services for any commercial purpose without written consent.

5. USER RESPONSIBILITIES

Users agree to the following responsibilities:

  1. Ensure the accuracy of account information.

  2. Maintain confidentiality of login credentials.

  3. Monitor account activity for any unauthorized usage.

  4. Use the Services only for lawful and permitted purposes.

  5. Ensure that users understand safe and responsible usage guidelines.

  6. Immediately notify Chatterfly App of any security breach.

  7. Use appropriate language and behavior when engaging with AI.

  8. Not request advice outside the scope of the Service.

  9. Not upload or transmit sensitive personal information (medical, financial, legal, precise location, or identity documents).

Users take full responsibility for their actions on the platform.

6. PROHIBITED USES

By using the Services, you agree that you will not:

  1. Attempt to reverse engineer, copy, modify, or distribute any part of the Services.
    b. Use the Services for any unlawful purpose.

  2. Upload harmful, hateful, explicit, violent, discriminatory, or inappropriate content.

  3. Exploit, harm, or attempt to manipulate the AI for harmful purposes.

  4. Engage in harassment, threats, bullying, or unsafe behavior.

  5. Misrepresent your identity or attempt to impersonate others.

  6. Use bots, automation tools, viruses, malware, or code injections.

  7. Use Chatterfly App to train external AI models or scrape data.

  8. Use the Services to deliver professional therapy or counseling.

  9. Engage in any activity that interferes with the proper functioning of the Services.

Violation of this section may lead to immediate account termination without refund, as well as legal action.

7. ACCOUNT CREATION AND DELETION

7.1. Creating an Account
Users must create an individual account using a valid email address and must complete email verification before accessing the Service.

7.2. Account Termination by User
Users may delete their account at any time. Parents may also delete their teen’s account if the user is between 13–17. Once an account is deleted, the process is permanent, the data is erased, and the account cannot be restored. 

Deletion of  account is permanent, however, certain minimal data may remain in encrypted system backups for up to 30 days for legal, financial, or compliance purposes. After this period, all such data is permanently deleted.

7.3. Termination by Chatterfly App
Chatterfly App may suspend or terminate an account, without prior notice, if we determine that the user has violated these Terms, misused the AI or communication features, engaged in unsafe, abusive, or harmful behavior, poses a security risk, or if termination is required by law or regulatory obligations. Accounts found to be created or used by children under 13 will be terminated immediately and all associated data will be deleted.

7.4. Right to Appeal
If an account is terminated, a parent or the account holder (if 18 or older) may submit an appeal request. Chatterfly App will review all appeals fairly and respond within a reasonable timeframe. Appeals cannot be submitted for accounts deleted due to age violations under 13, as these must be permanently removed for compliance reasons.

8. IN-APP PURCHASES AND CREDITS
Chatterfly App may offer various forms of paid digital content and features designed to enhance the user experience. These may include:

  1. Paid credits used to access certain interactions or premium tools.

  2. Subscriptions that unlock ongoing or recurring features.

  3. Unlockable features available through one-time purchases.

  4. Upgraded content or expanded functionality accessible through additional payments.

All purchases are optional, and users are fully responsible for managing and supervising any expenditures made within the app.

8.1. Payment Terms
All in-app purchases are processed securely through the Apple App Store or Google Play Store, and users must comply with the payment terms of those platforms. Prices for credits, subscriptions, and premium features may change at any time without prior notice, and continued use of the Service after such changes constitutes acceptance of the updated pricing. Refunds for purchases are generally governed by Apple’s and Google’s refund policies, and Chatterfly App does not have authority to override or modify those policies. Any user seeking a refund must submit the request directly through the corresponding app store.

8.2. Credit Expiration
Unused credits may expire under specific circumstances, including:

  1. When an account is permanently deleted at the request of a user.

  2. When an account is suspended or terminated due to violations of these Terms.

  3. When a user requests deletion of personal data that is necessary to maintain credit balances or purchase histories.

  4. No refunds will be issued for expired or unused credits unless required by applicable law. Users are strongly encouraged to monitor credit usage to prevent unintended loss.

9. INTELLECTUAL PROPERTY AND COPYRIGHT

9.1. Ownership

All text, graphics, logos, audio files, app design elements, software components, AI training prompts, branding materials, user interface elements, and all other copyrighted materials contained within or associated with the Chatterfly App and its Services are the exclusive property of Back to Basics Behavior Services, LLC. These materials are protected by applicable copyright, trademark, and intellectual property laws. No part of the Services may be used in any manner that infringes upon or violates these rights.

9.2. User-Generated Content

By uploading, submitting, or inputting any content (including your feedback, reviews and comments) into the Service, you grant Chatterfly App a limited, non-exclusive, and revocable license to process and use that content solely for operational and functional purposes, such as generating AI responses or maintaining app performance. You affirm that you either own the content or have the necessary rights and permissions to provide it to us. You also agree not to upload, submit, or transmit any copyrighted, protected, or otherwise infringing material through the Services.

9.3. Restrictions

Users may not copy, reproduce, distribute, modify, reverse engineer, sell, lease, or use any part of the Chatterfly App content or Services to train external AI systems without obtaining prior written permission from Back to Basics Behavior Services, LLC. Any unauthorized use, redistribution, or reproduction of any materials associated with Chatterfly App is strictly prohibited and may result in legal action

10. AI-GENERATED CONTENT DISCLAIMER

Chatterfly App uses artificial intelligence tools, including third-party AI APIs such as OpenAI, to generate audio interactions and conversational outputs.

10.1. No Guarantee of Accuracy

AI-generated content may be imperfect, incomplete, inaccurate, outdated, unexpected, or, in rare cases, nonsensical, and users must not rely on any AI-generated responses for factual, medical, legal, behavioral, therapeutic, or safety-critical decisions.

10.2. No Human Review

AI-generated content may not be reviewed or moderated by humans before delivery.

10.3. User Responsibility

Users must review AI content critically and avoid using it for any prohibited or unsafe purpose.

11. EDUCATIONAL AND NON-THERAPEUTIC DISCLAIMER

Chatterfly App provides general learning, communication practice, and conversational tools only. It does not provide psychological evaluation, therapy, counseling, behavioral treatment, mental-health diagnosis, crisis support, emergency intervention, medical guidance, or pharmaceutical or supplement suggestions. Users must not treat Chatterfly App as a replacement for professional care. If a user requires therapy, diagnosis, supportive services, or any form of clinical intervention, users agree to seek assistance from qualified and licensed professionals who can provide proper evaluation and care.

12. BEHAVIORAL DISCLAIMER

Even though users with special needs may benefit from communication-practice tools, Chatterfly App does not provide individualized behavioral programs, does not function as ABA therapy, does not offer behavior modification services, and does not diagnose developmental or behavioral conditions. The Service cannot predict behavioral outcomes and cannot ensure improvements in communication abilities, behavioral development, or social progress. Users remain solely responsible for managing their own behavioral, developmental, or therapeutic needs and must not rely on the app as a substitute for specialized professional support.

13. MEDICAL DISCLAIMER

Chatterfly App does not provide medical advice, treatment, health recommendations, clinical assessments, prognoses, emergency assistance, or decisions regarding medication, supplements, or any aspect of medical care. The content generated through the Service is not intended to diagnose, treat, cure, or prevent any medical or psychological condition. In the event of an emergency, including a medical emergency, mental-health crisis, thoughts of self-harm, suicidal ideation, or any dangerous or harmful behavior, users must immediately contact emergency services or appropriate crisis-response professionals. Chatterfly App cannot and does not provide emergency support, crisis intervention, or real-time monitoring for safety-critical situations.

14. GENERAL SERVICES DISCLAIMER
Chatterfly App is provided on an “as-is” and “as-available” basis, and we do not guarantee that the Services will be uninterrupted or error-free, that AI-generated content will always be consistent or reliable, that the app will function on every device or operating system, that stored data will remain continuously accessible, or that the Services will meet every user’s individual expectations. By using the app, users acknowledge and accept that they assume all risks associated with AI-generated interactions, mobile application performance, and any limitations inherent to software-based tools.

15. THIRD-PARTY SERVICES

Chatterfly App uses various third-party service providers to operate its platform, including but not limited to OpenAI for AI processing, cloud hosting providers for data storage and infrastructure, email verification providers for account authentication, and crash-analytics tools that help ensure app stability and security. The use of these third-party services is governed by their own respective terms and privacy policies, and users understand that Back to Basics Behavior Services, LLC is not responsible for outages, errors, service interruptions, data-processing practices, or failures arising from these external providers.

17. DEVICE COMPATIBILITY

We do not guarantee that the Services will work on every device, operating system version, or hardware configuration. Device-related issues are the responsibility of the user.

18. UPDATES AND MODIFICATIONS
We may modify the features, tools, AI behavior, app design, payment structure, and these Terms at any time to improve the Service or comply with legal, operational, or technical requirements. Chatterfly App will notify users of any material changes, and continued use of the Service after such updates constitutes acceptance of the revised Terms.

19. INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Back to Basics Behavior Services, LLC, along with its employees, partners, contractors, and affiliates, from any claims, damages, losses, liabilities, or expenses arising from your use of the Services, your use of the Services, any violation of these Terms, any misuse of AI-generated content, any uploading or transmission of harmful or infringing material, or any unauthorized or unsafe use of the Services.

20. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Chatterfly App disclaims liability for any indirect, incidental, consequential, punitive, or special damages arising from the use or inability to use the Services. Chatterfly App is not responsible for AI inaccuracies, app interruptions, device-related issues, or loss of data, nor is it liable for actions taken based on AI-generated content. Chatterfly App does not guarantee therapy results, communication improvements, behavioral changes, learning outcomes, or any other specific developmental impact. Users accept full responsibility for all decisions and actions taken based on their use of the Service.

21. NO GUARANTEES OR WARRANTIES
Chatterfly App does not guarantee specific learning improvements, behavioral outcomes, increased communication abilities, uninterrupted service uptime, AI accuracy, device compatibility, or error-free performance. All warranties, whether express or implied, including warranties of fitness for a particular purpose, merchantability, or non-infringement, are expressly disclaimed to the fullest extent permitted by law.

22. APPEALS AND COMPLAINTS
Users may appeal account termination decisions, request reinstatement, file complaints regarding improper use, or request investigation into safety-related incidents. Chatterfly App will review all appeals and complaints in good faith and provide a response within a reasonable period based on the nature and complexity of the request.

23. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that any dispute must be resolved in California courts. By using our services you consent to personal jurisdiction in California.

24. SEVERABILITY

If a provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

25. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, represent the entire agreement between you and Chatterfly App.
